Draft text. The company details (bracketed fields) are not defined yet; before going live, the LEGAL_* environment variables must be filled in and the text reviewed by a lawyer.
This text is the Pre-Contract Information Form and Distance Sales Agreement prepared under the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (Official Gazette 27.11.2014, 29188, as amended). It applies to users who purchase as consumers. For those who use the service for commercial purposes, the Terms of Service apply.
1. Seller
- Seller: [Company legal name]
- Address: [Address]
- Tax office / Tax ID: [Tax office] / [Tax ID]
- Phone: [Phone]
- Email: destek@shopstage.net
2. Buyer
The buyer is the user who creates the Shopstage account and enters their details on the payment screen.
3. Subject of the contract and characteristics of the service
The subject of the contract is the electronic delivery of the monthly or yearly subscription plan, or the one-time AI credit pack, chosen by the buyer. The service includes connecting store and social media accounts, AI content generation, scheduling and publishing, assistant replies to customer messages, and analytics. The scope of the plan and the credit amount are shown on the payment screen. Subscriptions include a 7-day trial; when it ends, the chosen plan begins and periods renew unless cancelled.
4. Price and payment
The total fee, including taxes, is shown on the payment screen; prices include VAT. The price may be in USD or TRY depending on the provider. Payment is taken through the payment provider (iyzico, PayTR, Stripe or Shopify Billing; the active one is shown on the payment screen) by credit/debit card or another method the provider offers. Card details are not sent to the seller. The subscription fee is charged in advance at the start of each period.
5. Performance and delivery
The service is provided electronically; there is no physical delivery or shipping. After the payment is confirmed, the plan and credits are applied to the account immediately and performance of the service begins at once.
6. Right of withdrawal
The buyer has the right to withdraw from the contract within 14 days without giving a reason and without paying a penalty; the period starts on the day the contract is formed. However, under Article 15/1(g-breve) of the Regulation, the right of withdrawal cannot be used for services performed instantly in an electronic environment and services whose performance has begun with the consumer's approval. The buyer confirms during payment that the service will start immediately and that the right of withdrawal will end in that case. Therefore:
- There is no right of withdrawal for used credits and plans whose use has begun.
- If a withdrawal notice is given within 14 days before the plan or credit pack has been used at all, the fee is refunded.
The withdrawal notice is sent by email to destek@shopstage.net; no particular form is required. The fee is refunded, within 14 days of the notice at the latest, to the method the payment was made with. For details, see the Refunds and Cancellation page.
7. Default
If the buyer fails to meet the payment obligation, the service may be suspended. If the seller defaults on performance, the buyer's rights under the Law and the Regulation are reserved.
8. Dispute resolution
For disputes, the Consumer Arbitration Committees at the buyer's place of residence or where the transaction took place have jurisdiction within the monetary limits announced each year by the Ministry of Trade, and the Consumer Courts have jurisdiction over disputes above those limits.
9. Entry into force
Before payment, the buyer declares that they have read and electronically approved this pre-contract information and accepts that the contract is formed upon payment confirmation.
